This privacy statement applies to the processing of personal data of customers that make use of Just Eat Takeaway.com’s Webshop. The data controller for processing these personal data is Just Eat Takeaway.com Group B.V. (hereinafter referred to as ‘’JET’’).

 

JET is responsible for the processing of your personal data and takes your privacy seriously. JET therefore adheres to the requirements of the General Data Protection Regulation (GDPR) when processing personal data.

 

What data we process and why

JET processes your data because you use our Webshop. We use the following personal data for the following purposes.

 

1. Ordering process

 

We process the following personal data that is necessary to execute your order in our Webshop, the legal basis for this processing of personal data is the performance of a contract with you. We process the following data for this purpose:

2. Reviews

 

Aside from the above processing operations, we process personal data you provide when submitting a review on our Webshop. You can withdraw your consent by contacting us via our privacy form. We process the following personal data when you post a review:

3. Customer services

 

When you contact our customer services department, we will use the personal data you provide to answer your question or handle your complaint. The legal basis for this processing of personal data is that it is needed for the performance of a contract as defined in the GDPR. 4. Account

To be able to order via our Webshop you will have to register with an account. This account is necessary to make sure we only provide our services to our partner restaurants and others within the catering and hospitality sectors.

 

If you are not a restaurant registered to our main platform we may ask you for your Chamber of commerce number and/or VAT number to make sure we are only providing our services to the catering and hospitality sectors. We process the following personal data to create and maintain your account:

-       Contact details

-       Chamber of commerce number (if applicable)

-       VAT number (if applicable)

-       Order data

-       Payment details data

 

5. Marketing messages

 

We also process your data to be able to send you (personalised) marketing messages and notifications. We process your personal data for marketing purposes based on your consent. Whenever you want to change your preferences with respect to receiving such messages and notifications, you can unsubscribe using the link in the message in question. We process the following data for marketing purposes:

-       Postal code

 

6. Campaigns and competitions

 

JET also processes your personal data when you enter into one of our campaigns and/or competitions. We only process your personal data for campaigns and/or competitions if you’ve provided us with your consent. We process the following data for these campaigns and competitions:

-       Campaign contributions (if applicable)

 

7. Cookies

 

In addition, JET uses cookies for functional, analytical and marketing purposes. The functional cookies are necessary for the use of the website. The data from the analytical and marketing cookies are not linked to the other data you provide during the ordering process. Please refer to our Cookie Statement for more information about cookies.

 

Additional purposes

We will only use the data obtained via the Technologies for the purposes described above. If we want to use the data for a different purpose, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Where required by applicable data protection law, we will obtain your consent.

 

Automated decision making

JET uses automated decision making and profiling to execute the agreement with you and to improve our platform. If you are a partner restaurant, JET uses your revenue data to set a spending cap based on the restaurant revenue and uses your restaurant data (e.g. kitchen type and menu) to provide you with a more personalized shopping experience. Negative automated decisions will always be subject to human involvement.

 

Sharing with external suppliers

JET shares your personal data with the external supplier in case you ordered with an external supplier, so that that supplier can deliver your order. If you ordered with an external supplier you are a direct customer of that supplier, the supplier has its own responsibility and obligations with respect to the processing of your data. If you have questions about how the supplier handles your data, you should contact the supplier directly.

 

Sharing with others (not being suppliers)

JET will not sell your data to third parties, and we will only disclose them to third parties if necessary for the performance of our contract with you, for analytical and marketing purposes, or to comply with legal obligations.

Third-party websites

Our website may include links to third-party websites. When accessing such third-party websites, bear in mind that each of these websites has its own privacy statement. Although JET takes great care in selecting websites to link to, we cannot assume responsibility for the way in which they handle your data.

 

Where your data gets sent

We may transfer your personal data outside of the European Economic Area. This may include transferring it to or accessing it from other jurisdictions that may not provide a level of protection equivalent to the EU data protection laws. Where we transfer personal data we will take account of any applicable statutory obligations relevant to personal data transfers and, where there isn't a European Commission (EC) adequacy decision in place, we will rely on appropriate safeguards, including EC approved standard contractual clauses. We have implemented similar appropriate safeguards with our third party service providers and further details can be provided upon request.

 

How long we keep your data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

 

In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may use such information without further notice to you.

 

Rights, questions or complaints

We inform you that, with regard to the personal data, you can exercise the rights provided for by the GDPR which include: the right to request access to, rectification of, or erasure of personal data or restriction of processing, and to object to processing, the right to data portability, to withdraw your consent at any time (without prejudice to the lawfulness of the processing based on the consent given prior to the withdrawal) as well as to lodge a complaint with a supervisory authority.
